Introduction
This Privacy Policy (“Privacy Policy”) describes what information David J. Frank Landscape Contracting, Inc. (“DJFLCI”) collects from visitors to its website located www.davidjfrank.com (the “Website”), and how we will use that information once it is collected. This Privacy Policy does not apply to any other website, including websites used by DJFLCI for credit card processing services.

Collection of Non-personal Data
If you browse the Website, you do so anonymously.  DJFLCI does not collect your e-mail address or other personal information.  DJFLCI may log your IP address (the internet address of your computer) to tell DJFLCI which parts of our Website you visit and how long you spend there.  DJFLCI does not link your IP address to anything personally identifiable; however, DJFLCI may track the state and/or country you are accessing the internet from, the date and time you visited and the type of computer, operating system and Web browser you are using.  Your browser supplies DJFLCI with this information.  DJFLCI may use this information to learn more about our visitors as a group, not about you as an individual.  The information helps DJFLCI identify overall usage patterns and trends on the site.

Collection and Use of Your Personal Information
The Website enables visitors to contact DJFLCI by email or through the use of email forms located on the Website.  The Website also allows visitors to subscribe to receive updates about my books and other activities via email.  To provide these services, the Website contains various forms where you can input personal information such name, phone number, mailing address and/or email address.  DJFLCI will not sell this information.  However, DJFLCI may share this information with other service providers that provide services on this Website, including credit card processing services providers.

Removing or Updating Personal Information
If you believe your personal information is not accurate, or if you would like DJFLCI to delete your personal information, contact us at it@davidjfrank.com or call 262-250-4348.

Disclosure of Your Personal Information
DJFLCI may disclose your personal information if required to do so by law or in the good-faith belief that such action is necessary to: (a) satisfy a legal order or comply with legal process; (b) defend my rights and enforce my intellectual property; or (c) protect the personal safety of any DJFLCI employees, affiliates, business partners, customers or Website users.

This website does not use a secure server to transmit sensitive data to and from our site.  Be sure not to transmit any credit card or other financial or sensitive data through this website unless you have first verified that the data is being submitted to our third-party service provider’s secure server.

 

Governing Law and Jurisdiction

 

This Policy and the collection and use of customer information, shall be governed and interpreted in accordance with the laws of the United States and the State of Wisconsin.  Any disputes arising out of this Policy shall be adjudicated in a court of competent jurisdiction in Wisconsin.

Dispute Resolution

 

You and DJFLCI agree that disputes related to this Privacy Policy will be handled through arbitration, except that either you or DJFLCI may bring a lawsuit solely for injunctive relief to stop unauthorized use of the DJFLCI Platform or any copyright, trademark or other intellectual property infringement.  Prior to commencing an arbitration proceeding, we ask that you attempt to resolve any claim informally by contacting it@davidjfrank.com.  If your claim is not resolved within 15 days of the day you contact DJFLCI regarding your claim, you or DJFLCI may initiate a formal arbitration proceeding in accordance with this Policy.

EXCEPT AS PROHIBITED BY LAW, YOU AGREE THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS PRIVACY POLICY SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, CLASS ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, MASS ACTION OR ANY OTHER SIMILAR TYPE OF CONSOLIDATION OF CLAIMS AND EXCLUSIVELY BY STATE OR FEDERAL COURTS SITUATED IN WASHINGTON COUNTY, WISCONSIN, (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) NO PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, INCLUDING WITHOUT LIMITATION, LOST PROFITS, MAY BE AWARDED (COLLECTIVELY, “SPECIAL DAMAGES”), AND (4) ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM SPECIAL DAMAGES AND ALL RIGHTS TO HAVE SUCH DAMAGES MULTIPLIED OR INCREASED.

You agree that any claim that you have against DJFLCI must be brought within twelve (12) months of the date that the claim arose.

Privacy Policy Changes

 

DJFLCI reserve the right to change its Privacy Policy at any time without prior notice. Any changes to the Privacy Policy will be posted on this page and will be effective immediately upon posting.
